PAMOJA AFRICA: TERMS AND CONDITIONS

Acceptance of Terms

By accessing the Pamoja Africa website, mobile application, or by using a Pamoja NFC Medical Profile Card, you agree to be bound by these Terms and Conditions. If you do not agree, you must immediately cease use of our services.

Description of Services

Pamoja Africa provides an integrated platform for:

• Medical Data Storage: Encrypted medical profiles accessible via NFC/QR.
• Health Vouchers: A digital wallet for prepaying medical services.
• Crowdfunding: A platform to raise funds for verified medical emergencies.

No Medical Advice

Pamoja Africa is a technology provider, not a medical institution.

• We do not provide medical diagnoses, treatments, or advice.
• The Medical Profile Card is a tool for information sharing only. In an emergency, Pamoja Africa is not liable for the actions or inactions of first responders or medical personnel.

User Accounts and Security

• Users are responsible for maintaining the confidentiality of their login credentials.
• You agree to provide accurate and truthful information. Falsifying medical data on your profile is a violation of these terms and may lead to account suspension.

Health Voucher System (Financial Terms)

• Usage: Vouchers are redeemable only at Pamoja-registered Healthcare Partners.
• Transferability: Vouchers may be transferred to third parties within the Pamoja network.
• Non-Refundability: Vouchers are generally non-refundable for cash but remain valid for medical services at any partner facility.
• Expiration: Prepaid vouchers do not expire as long as the account remains active.

Crowdfunding Rules

• Purpose: Campaigns must be for legitimate medical purposes only.
• Disbursement: To prevent fraud, funds raised via Pamoja Africa are paid directly to the healthcare provider via the voucher system. No cash is disbursed to individual users.
• Fees: Pamoja Africa retains a 10% platform fee on successful campaigns to cover administrative and processing costs.

Agent Referral Program

• Status: Agents are independent contractors and NOT employees of Pamoja Africa.
• Commissions: Agents earn a 2% commission on voucher sales and a R25 commission on NFC card sales.
• Conduct: Agents must not misrepresent Pamoja Africa services or provide unauthorized medical advice.

Limitation of Liability

To the maximum extent permitted by South African law, Pamoja Africa shall not be liable for:

• Inaccuracies in user-provided medical data.
• Failure of a healthcare partner to provide services.
• Technical failures of the NFC card or mobile app during an emergency.
• Any indirect or consequential financial loss.

Termination of Service

We reserve the right to terminate or suspend access to our services without prior notice for:

• Fraudulent crowdfunding activity.
• Breach of these Terms and Conditions.
• Non-payment of applicable fees.

Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Johannesburg.
